Getting Familiar With Dog Bite Lawyer

Benefits of Hiring a Dog Bite Attorney

What Should You Do After a Dog Attack?

Since dog bites happen every day you need to be prepared in case it happens to you. If you or a loved one was injured by a dog this is what you should do:

  • Get medical treatment as soon as possible: The first thing you need to do if a loved one is injured by a dog or other animal is to seek proper medical attention. Some injuries may appear to be minor at first but you should always get them checked out by a doctor at the emergency room. Don’t delay on medical treatment as it may have a long-lasting impact.
  • Get information on the dog that bit you: If you can identify the dog that bit you, this will help you with your personal injury claim. If you know the homeowners where the incident occurred this is also helpful. Since the owner is the responsible person under California law it’s essential that you identify who they were and get their contact information.
  • Report the incident: It’s important that you report the attack to the police or animal control agency in the area. This is the first step you can take in preventing similar attacks by the same dog in the future. It also provides a record of the incident and they can determine if this was part of the dog’s pattern.
  • Take pictures and collect evidence: Collecting evidence after a dog attack starts with getting good records. In addition to the homeowner’s names and contact information, you need to document your injuries. Take pictures of your injuries and record the impact the injuries have on your day to day life.
  • Do not sign anything with an insurance company without talking to a lawyer first: Insurance companies may seem quick to help and write a check after a dog attack incident, but there could be more damage. If you sign something or indicate that you’re not injured you could hurt your case. It’s essential that you talk with a California Personal injury lawyer right away before talking to an insurance company.

Key Benefits Of Hiring A Dog Bite Lawyer To Handle Your Case

Being the victim of a vicious dog attack can leave emotional and physical scars that can stay with you for a very long time. If a dog bite has left you permanently disfigured and psychologically affected for life, you deserve compensation for your ordeal. Animals are wild by nature and even the most trained and docile dogs can and do go on the attack. Sometimes dogs are bred by their owners to be vicious. In either case, their teeth and claws are considered dangerous weapons. This is why those owners need to be held accountable for the aggression displayed by their pets.

Whether you were victimized yourself or witnessed your child or other loved one endure a traumatizing attack, it’s important you consult with a dog bite lawyer in Los Angeles right away to increase your chances of securing fair compensation. Our experienced lawyers work with dog bite lawsuits every day and will do whatever we can to hold the dog owner responsible.

Every day in this country, about 1,000 people seek care in emergency rooms for serious dog bite injuries. Each year, 9,500 people are hospitalized for those injuries and 900 die, according to DogsBite.org. If you or a loved one have been impacted by a dog bite, we can help you. Let’s explore the key benefits of hiring a dog bite lawyer in Los Angeles to handle your case.

Expert Negotiation Skills

Most people fear negotiations due to the conflict, tenacity and diligence it takes to do it right. But a dog bite lawyer handles these types of cases for a living and has extensive experience dealing with insurance companies. While you may likely be confused over whether the settlement offered by your insurance company is fair, your attorney knows it isn’t and can fight for more. Just because you received an offer from the insurance company doesn’t mean you should accept it. An experienced attorney can review the offer and counter with the amount you truly deserve. Often times, this process can go back and forth several times until the right amount is agreed on. If you don’t have the time, patience, follow through or resources to push repeatedly for what you deserve, you’re best off hiring a dog bite lawyer in Los Angeles to do this for you. Another bonus: because of our track record of perseverance, insurance companies fear us. This puts us in a good negotiating position right out of the gate.

Vast Legal Knowledge

Likewise, the general public doesn’t have a firm grasp of the intricacies of California law. Those laws are extremely complex, and it’s our full-time job to know them inside and out. You likely have your own job you’re trying to keep up with, especially in light of your recent injuries. You’re also dealing with a lot on your plate as you try to recover from your attack or nurse your loved one back to health. An experienced attorney understands how to interpret the laws and use that knowledge to help you make a fair recovery.

Experience

With the prevalence of online legal sites these days, everyone thinks they know how to successfully negotiate their own case. However, the truth is, online resources can be helpful but they can’t replace personal, professional experience. Dog bite lawyers handle these types of cases every single day. Chances are, they’ve seen a similar case to yours this week alone. They can use those case studies and examples to educate you on the process, show you what to expect and get the full compensation you deserve.

Proving Related Complications

A dog bite itself may not seem serious at first, even if it hurts. But over time, a bite may result in more serious medical complications that can be simultaneously painful and expensive. In these cases, it is best to contact a lawyer who can work with you to prove that said complications are indeed the result of the initial bite. Proving this on your own can be near impossible, often simply devolving into a case of “he said, she said” in court. On the other hand, an attorney can build a convincing case with the help of medical professionals testifying on your behalf, leaving no doubt that the dog bite is to blame for resulting medical issues.

Proving Liability

Another major aspect of dog bite cases is that of liability, which is more complicated and nuanced than it may seem at first glance. However, a knowledgeable attorney is capable of working with you to ensure that the liable party is charged appropriately. For example, a lawyer may discover during the collection of evidence that the dog’s owner actually had knowledge of the dog attacking others in the past and was negligent in not taking the necessary, subsequent precautions. This is just one instance in which an attorney can define a case in your favor.

Defending False Charges

It may be that the dog’s owner seeks to pin liability on you, claiming perhaps that you were on their property illegally, or that you provoked the dog in a way that caused it to attack in self-defense. Without the aid of an attorney, it may be unlikely that you can argue against these charges successfully in court. Conversely, an attorney that is familiar with charges commonly brought against victims of a dog bite can work effectively to have these charges dismissed and your claim reviewed fairly.

Knowledge of Dog Bite Laws

Every state in the country, including California, has dog bite laws covering various types of claims. California’s dog bite law, section 3342 of the Civil Code, states that the owner of any dog is liable for damages if:

  • A dog bite caused the injuries
  • The person bitten was in a public place or lawfully in a private place.

A lawyer can help you begin a claim against the pet owner for medical expenses, lost wages, pain, and suffering, and injuries that resulted in disfigurement, fractures, or cosmetic surgery. An experienced lawyer understands how to interpret dog bite laws and will be up-to-date on the relevant legislation.

Access to Valuable Resources

When you hire a dog bite lawyer, there’s a team of people who contribute to your case. There may be a lead attorney, a paralegal who does the research, and investigators who collect the evidence. To handle such complex matters, it usually takes a team of skilled and experienced individuals who’ve been doing this for years. This is why hiring a lawyer will ensure you don’t have to go through any stage of the process alone.

Types of Compensation You May Be Entitled To

Although the law in California is geared towards actual bites you may be eligible for compensation for other animal-related injuries as well. You will need to speak with an attorney to get a good idea of if you have a case or not. In California, GJEL seeks to recover the maximum amount possible to take care of our clients.

This doesn’t just include medical bills. In a typical personal injury case we will look at a variety of factors and you may be able to get compensated for:

  • Medical bills resulting from the injury (past and future)
  • Pain and suffering
  • Loss of earnings from missing work due to the injury
  • Reduction of lifetime earnings due to the inability to do your job properly
  • Changes to your lifestyle from the injury
  • Lifetime care and medical expenses if necessary

What To Search For When Deciding On A Criminal Defense Attorney

Legendary criminal defense attorney, who represented the famous and the infamous, has died

At what point do you mention that death finally came for him, filing one motion he could not quash? died Tuesday at age 78. He had been fighting cancer in recent years, and long suffered from a neuromuscular disorder called dystonia that sometimes makes muscles contract involuntarily. He walked with a cane or used a scooter but even that, he used to his legal advantage.

“When he was trying to do something in front of the jury, of course his limp got markedly worse,” said World Business Chicago CEO, a former federal prosecutor and first assistant Cook County state’s attorney. “I saw that happen more times than one.”

“Sometimes when he was cross-examining an eyewitness,” said former U.S. “I would so admire what he was doing, I would forget I’m on the other side.”

Underline the word “criminal” in the sentence above. got many, many defendants off the hook, but that does not mean they were innocent. Just the opposite.

Win or lose, seeing in action was a lifetime experience. Courtroom benches filled when word got around that he was about to cross-examine witnesses. His questioning made jurors wonder if they were tainted by money or revenge or fear.

Criminal Lawyers with 50+ Years’ Experience helping Clients

Most people go their entire life without dealing with the criminal courts.  Unfortunately, there are times when people make mistakes or misjudgments for whatever reason.  They get pulled over for a DUI, they get cited for retail theft, they get involved in a fight, or they are found possessing a controlled substance.

Many people think that just because they were cited or arrested that they are guilty.  This is not the case.  You have to remember, no matter how bad things look, you are innocent until the Commonwealth proves you guilty of each of the charged offenses beyond a reasonable doubt after a full trial in front of a jury of your peers.

That means, if you are charged with a DUI, the Commonwealth has to present compelling evidence and testimony in open court, before a judge and jury, which proves you were driving under the influence of alcohol or a controlled substance which resulted in you being incapable of safe driving.  As you can see, there is a lot they have to do and even more they have to prove.  As a result, the law favors you

The “beyond a reasonable doubt” standard is not to be taken lightly.  It is the highest standard under the law and, believe it or not, very difficult for the Commonwealth to meet.  Even with all the evidence in the Commonwealth’s favor, a defendant still has the absolute right to cross examine the Commonwealth’s witnesses; to question the processes which may or may not have been followed; to present alternate theories as to the facts presented; and to pick apart the evidence used against you through counter witnesses and experts.  Skilled Criminal Defense Attorneys can present these and numerous other defenses to create doubt in the jury’s minds and return a verdict of not guilty.

Criminal Defense Lawyers are with you and advising you every step of the way

Did you know that effective representation begins right after your initial contact with law enforcement?  As they say, the best defense is a good offense.  The sooner we get involved the more we can do to aid you.  For instance, we evaluate every encounter to determine whether the police have followed proper protocol when investigating the alleged crime?  Did you feel that you were free to leave or were you placed under arrest?  Did you make any written or oral statements?  Were you alone or with someone?  These questions, and many others

Can Criminal Defense Attorneys Contact Victims?

Criminal charges can be chaotic for you and everyone involved, and you may be uncertain how to move forward and get your life back on track after being accused of an offense. Hiring an experienced criminal defense attorney will allow your case to be handled by a team that has helped many others who have been in your situation. A skilled attorney will do everything within the scope of the law to bring a successful outcome to your case

This may include speaking with the alleged victim in order to find an acceptable way for all parties to easily resolve legal proceedings. Speaking with a victim may not always make things better for your case. As criminal defense attorneys with years of experience

Who Should and Should Not Contact Victims?

If you have been arrested and are awaiting a hearing or trial, the alleged victim of your offense is a witness in your case, and the evidence they provide may be impactful in determining the outcome. While the police or prosecutor may inform this person that they do not have to speak with anyone if they do not want to, your lawyer has the right to contact them and ask if they’d be willing to discuss what’s going on.

Your Criminal Defense Attorney Can Strengthen Your Case by Contacting the Victim

As your case moves forward, your lawyer will work to build the best defense possible, but it is important to see if there are any factors that will resolve your case before it goes to trial. As criminal defense lawyers, we would like to resolve our clients’ cases successfully and quickly, so we can help you and your family to move on with your lives. Each case is different, but it’s possible that your alleged victim would like to drop the charges. Sometimes this can be done if a lawyer has a productive meeting with them.

A Skilled Criminal Defense Attorney Can Help

Criminal prosecutions are taken very seriously, and you can be looking at prison time, large fines, and a permanent record if convicted of an offense. Your best opportunity to protect your rights and freedom comes from having a skilled attorney working for you and contacting any relevant witnesses or alleged victims in your case. Do not attempt to contact the victim on your own without first speaking to your legal counsel, as an experienced lawyer will know how to best move forward with this task.

Things to Consider When Hiring a Defense Attorney

For those that have run afoul of the law, choosing a criminal defense attorney to mount their defense in court can be a life changing decision. Regardless of the gravity of the crime, it’s important to hire an attorney as quickly as possible. In felony cases this rings doubly true, as the stakes are often much higher. But even misdemeanor cases go better for defendants who have an experienced attorney on their side.

When deciding who to trust with the case, the first thing to consider is experience. A law firm that has handled and won many other similar cases is simply better suited for the job. Those accused of serious felony crimes certainly don’t want to trust their futures to lawyers who make most of their bread and butter off fighting traffic tickets.

Consider arranging a consultation with the attorney under consideration before signing a contract. During this meeting, don’t be afraid to ask questions. Try to get a good idea of what kind of similar work he or she has done in the past, what trial strategies would be recommended, and whether or not his or her associated fees are prohibitively high. Do keep in mind, however, that hiring a lawyer is one of the areas in which bargain hunting is not a great idea. When something as serious as a potential criminal conviction is on the line, clients are better off prioritizing skill and experience over lower cost.

The earlier this decision is made, the more time the attorney will have to prepare a client’s case before trial. Often pre-trial agreements in the form of plea bargains or sometimes even dismissals can be arranged, but this requires hiring a lawyer as soon as possible after arrest.

When working with a defense attorney, be sure to communicate openly both about knowledge of the incident and potential defense strategies. And remember that whatever lawyer is ultimately chosen, it’s a good idea to trust his or her judgment. Of course clients should understand and agree with their attorneys’ defense strategies, but keep in mind that the best results will be obtained with an attorney clients trust to make appropriate decisions on their behalf.

There are many online directories and services that can help you narrow down the millions of results that pop up when Googling “car accident lawyer.” These directories often provide additional inside information about an attorney or law firm, such as client reviews. Client reviews can tell you a lot about what to expect from your experience with a particular attorney.

Ask Your Family and Friends

Even with the rise of the internet, word of mouth in your trusted community is still an important way to get information and recommendations for any type of professional services—and a lawyer is no different! Pick up the Phone

Once you have a list of three to five possible candidates, it’s time to contact them directly. Almost every law firm these days has an option to fill out an online form to get more information. While this seems convenient to most people, calling a law firm can often give you a much better idea of how the firm works. For example, talking to someone on the phone can let you know whether the firm is all-business or takes a more friendly and personable approach. Did you feel like your call was welcome? If not, you may not ever feel welcome contacting the office—even if you are a client! You can’t get this type of feedback from an online communication

Tips On How To Find An Auto Accident Lawyer

But even the best advertisements don’t tell you anything about how to make the best choice for your individual personal injury or auto accident injury legal case

Ask friends and family for a referral. If someone you know has had a good experience with a particular law firm, that is definitely a plus. Some of the questions to inquire about including: whether an attorney worked on their case, as opposed to a paralegal; whether they were kept informed on the status of their case; and lastly, whether they felt that the case was handled in their best interest, not just to secure a lawyers fee

Research online and view attorney websites. Look for designations by US News & World Reports of Best Lawyers and Best Law firms, designations by Martindale-Hubble preeminent lawyers, or similar professional groups. Professional lawyers will be providing information that you need about the type of case you have, rather than just how great they are. Look for someone who offers free resources to help you understand what is involved in your case and helps you feel informed and confident about the legal process

Determine who has worked on cases like yours, and does so on a regular basis. Like any business, it is important to consider how long have they been around and whether their expertise centers on personal injury law. You need to look for someone with experience in your particular type of case

Look for a firm with a solid reputation in the community, and that includes community service. Is the lawyer involved in helping people in the community, or just in earning a fee? Dedicated to serving others is a great indication of ethics and community pride.

According to Florida dog bite law,the most common defendant is the owner of the dog; however, the degree of the owner’s liability varies between cases. In most cases, the owner is responsible for the dog’s actions regardless of whether they have any prior knowledge of the dog’s tendency to bite.

There are two limited exceptions to this rule in certain states. First, if the dog is provoked, the victim’s own negligence will be taken into account when determining damages. Second, if the bite occurs on the owner’s property, they usually cannot be found liable (unless the victim is under 6 years old) if there is an easily readable warning sign in a prominent place.

What Is the Statute of Limitations for Dog Bite Claims?

A statute of limitations is a law that states the amount of time following an incident the victim has to file a claim. After this time period expires, victims of dog bites may no longer bring their claims. Because of the statute of limitations, dog bite victims should not wait to contact an attorney in regard to their claim.

TYPES OF DOG BITE LAWSUITS

There are a few different types of dog bite lawsuits and determining which general category your claim falls under is an important first step.

  • AGGRESSIVE INCIDENTS

This category encompasses what most people think of when they think of a dog attack—a dog breaks loose from a leash and aggressively bites the victim. Cases may differ based on the type of dog, as some insurance policies will exclude coverage for breeds considered to be dangerous, like Pit Bulls or Rottweilers.

  • NON-AGGRESSIVE INCIDENTS

Dogs can bite without displaying any aggression at all. If not properly trained, a dog may nip when it gets excited, and depending on the breed, these bites may be enough to cause injury.

  • DOG ON DOG AGGRESSION

A dog acting aggressively can cause injuries to the people who happen to be nearby, as well as to the dog itself. The law may cover pain and suffering for humans, but it will not cover it for dogs.

WHAT TO DO AFTER BEING BITTEN BY A DOG

When you are bitten by a dog, it is important to follow a few steps to keep yourself as healthy as possible and that, from a legal standpoint, you have all you need to seek compensation:

  1. SEEK MEDICAL ATTENTION

First and foremost, address your immediate medical needs. Because dog bites can lead to serious complications, it is important that you visit a doctor. Even a bite that seems relatively harmless can lead to infection if left untreated.

  1. DOCUMENT THE INCIDENT

Documenting the incident can be useful if you file a compensation claim. Some pieces of information worth documenting are:

  • File a dog bite report
  • Pictures of your injuries and the place where the incident took place,
  • Dog owner contact information
  • Details of any witnesses to the attack
  • Medical bills
  • Lost wages

Generally speaking, the better documentation you have, the easier it will be to assess the amount of compensation you deserve.

  1. SPEAK WITH AN ATTORNEY

Finally, it is important that you contact a dog bite attorney. The laws in each state vary and consulting with an attorney who has experience in this area of law may help you in your pursuit of compensation.

ONTARIO DOG ATTACK LAWS

In Ontario, the Dog Owners’ Liability Act is the law that governs who will be responsible when a dog bites someone. Ontario places strict liability on the owners of dogs that attack other people or animals. The owner of a dog will be found “strictly liable” for the injuries caused by his or her dog on others. The law does not permit for a dog owner to dispute who was at fault or whether the dog had a tendency to bite. In the end, the dog owner is automatically financially responsible for covering your damages. In other words, under Ontario dog bite law, a dog that bites is the absolute responsibility of its owner. This concept is called strict liability under dog bite law in Ontario.

An property owner can also be responsible for a dog bite or dog attack in Ontario under a law called the Occupiers’ Liability Act. The Act mandates that anyone that owns or occupies a premise in Ontario needs to reasonably protect their visitors from foreseeable harm. Anyone that owns or occupies a premise in Ontario, whether a farm, a residential home or a any type of establishment – owes a duty of care to ensure that anyone that steps foot on their property is safeguarded against danger and defects on the property, including vicious dogs with a propensity to bite and attack.
